Terms and Conditions for Travlo

1. Applicability

These Terms and Conditions govern the access and use of Travlo’s services, including its website, mobile application, and other affiliated platforms (collectively referred to as “Platform”). By accessing or using the Platform, you agree to abide by these Terms and Conditions. If you do not agree, please refrain from using the Platform.

2. Eligibility to Use
  • Age Restriction: Users must be at least 18 years old to register or use Travlo’s services. For minors, parental or legal guardian supervision is mandatory. Travlo reserves the right to verify such supervision.
  • Legal Compliance: Users must comply with applicable laws and possess the legal authority to enter into binding agreements.
3. Content
  • Ownership: Travlo retains ownership of all content provided on the Platform, including but not limited to text, graphics, logos, and software.
  • User-Generated Content:Users may submit reviews, comments, or other content. By doing so, they grant Travlo a non-exclusive, perpetual, royalty-free license to use, reproduce, or modify such content.
  • Prohibited Content: Users must not upload content that is defamatory, obscene, or violates any laws.
4. Website
  • Use: The Travlo website is provided solely for personal and non-commercial use. The User shall not distribute, exchange, modify, sell, or transmit anything from the Website, including but not limited to text, images, audio, and video, for business, commercial, or public purposes.
  • Rights Granted: The User Agreement grants a limited, non-exclusive, non-transferable right to use this Website as expressly permitted. Users agree not to interrupt or attempt to interrupt the operation of the Website in any manner.
  • Registration: Access to certain features may only be available to registered Users. The registration process may require Users to provide certain information, which must be accurate. Travlo reserves the right to terminate access to the Website and services without prior notice for maintenance or other reasons.
  • Virus-Free Assurance: Travlo endeavors to ensure its content is free of malware or viruses. However, any data downloaded or obtained is done at the User’s discretion and risk.
  • User Responsibility:Users shall not host, upload, or transmit content that violates laws, infringes intellectual property, is obscene, fraudulent, or harmful. Report unlawful content to [email protected].
5. Bookings by Travel Agents
  • Agent Registration: Except with prior registration with Travlo as B2B agents, priority partners, or franchisees, and explicit permission to use the Website, all travel agents, tour operators, consolidators, or aggregators (“Travel Agents”) are barred from using this Website for any commercial or resale purpose.
  • Unauthorized Bookings: If any unauthorized bookings are detected, Travlo reserves the right to cancel all such bookings immediately without notice and withhold payments or refunds thereto. Travlo shall not be held liable for any incidental loss or damage arising from bookings made by such Travel Agents. The liability in such cases shall be borne solely by the Travel Agents.
  • Discounts and Offers: All discounts and offers mentioned on the Website are applicable only to legitimate bookings made by registered Users of Travlo.
6. Limited Liability of Travlo
  • Facilitator Role: Travlo acts as a facilitator by connecting the User with respective service providers such as airlines, hotels, restaurants, and bus operators (collectively “Service Providers”). Travlo’s liability is limited to providing the User with a confirmed booking as selected.
  • Service Quality: Any issues or concerns faced by the User while availing services are the sole responsibility of the Service Provider. Travlo will not be liable for acts, omissions, errors, representations, or negligence of Service Providers.
  • No Guarantees: Unless explicitly committed by Travlo as part of any product or service:
    • Travlo assumes no liability for the standard of services provided by Service Providers.
    • Travlo provides no guarantee regarding quality, reliability, or fitness of the services.
    • Travlo does not guarantee service availability as listed by Service Providers.
    • The ultimate contract of service is between the User and the Service Provider, with Travlo acting solely as a booking facilitator.
    • Information Accuracy: Travlo displays information as furnished by Service Providers and cannot be held liable for inaccuracies, outdated information, or non-compliance with laws by Service Providers.
7. User’s Responsibility
  • Accurate Information: Users must provide true and updated personal information.
  • Local Regulations: Users are responsible for complying with local laws, customs, and regulations during travel.
  • Conduct: Misuse of the Platform or disruptive behavior will result in account termination.
8. Security and Account-Related Information
  • Account Security: Users are responsible for safeguarding their account credentials.
  • Unauthorized Use: Notify Travlo immediately of unauthorized account access.
  • Fraud Monitoring: Travlo reserves the right to block accounts suspected of fraudulent activity.
9. Fees and Payment
  • Applicable Fees: Travlo reserves the right to charge convenience fees or service fees in addition to booking costs. Users will be informed of any applicable fees before confirming payments.
  • Short Payments: In cases of short charges due to technical errors or other reasons, Travlo reserves the right to claim the balance amount from the User. Bookings may be canceled if payment discrepancies are unresolved.
  • Refunds: Refunds are processed as per the service provider’s policy. Travlo ensures prompt refunds upon receipt from the provider.
  • Payment Methods: Accepted methods include credit cards, debit cards, UPI, and net banking. Travlo does not request payments to private accounts.
  • Security: Users must not share sensitive financial information. Travlo is not liable for losses arising from such disclosure.
10. Usage of the Mobile Number, Communication Details of the User by Travlo
  • Communication Modes: Travlo will send booking confirmations, itinerary information, cancellations, payment confirmations, refund statuses, schedule changes, or other relevant transactional details via SMS, internet-based messaging applications (like WhatsApp), email, or voice call.
  • Pending/Failed Bookings: Travlo may contact Users for pending or failed bookings to conclude the transaction.
  • Consent: Users unconditionally consent to such communications, which are considered “transactional” and not “unsolicited commercial communication” as per TRAI guidelines.
  • Indemnification:  Users indemnify Travlo against losses or damages caused by erroneous complaints or incorrect contact details provided during registration.
11. Insurance
  • Optional Coverage: Travlo offers travel insurance through third-party providers. Policy claims are subject to the insurer’s terms.
  • User Awareness: Users should review the policy details before purchase.
12. TCS Compliance
  • Definition of Overseas Tour Package: An “Overseas Tour Package” refers to any travel package that includes visits to countries or territories outside India, covering expenses such as travel, hotel stays, boarding, lodging, or any related expenditure.
  • Specified Person: A “Specified Person” is defined as per Section 206CCA(3) of the Income Tax Act, 1961.
  • TCS on Overseas Tour Packages:
    • Users are required to pay Tax Collected at Source (TCS) at the applicable rate over and above the price of the overseas tour package, in compliance with Section 206C(1G)(b) of the Income Tax Act.
    • Travlo will collect the TCS, deposit it with the government, and provide appropriate documentation or certificates to the User.
  • PAN Requirement:
    • Users must provide a valid PAN for themselves or the travelers at the time of booking an overseas tour package.
    • Travlo reserves the right to validate the PAN to ensure compliance with Section 206CC of the Income Tax Act. If the PAN is found invalid or does not belong to the User/travelers, Travlo may cancel the booking and process refunds as per the cancellation policy.
  • Higher TCS Rates for Specified Persons:
    • If the User qualifies as a “Specified Person” under Section 206CCA of the Income Tax Act, a higher TCS rate may apply.
    • Users agree to pay additional TCS if the amount collected initially is insufficient based on validation. Failure to pay additional TCS may result in booking cancellation, with refunds processed as per the applicable cancellation policy.
13. Compliance of Liberalized Remittance Scheme (LRS)
  • International Travel: Users availing of international services must comply with LRS and provide PAN details.
  • Regulations: Travlo ensures adherence to Reserve Bank of India guidelines.
14. Obligation to Obtain Visa
  • User Responsibility: Obtaining necessary visas is the sole responsibility of the User. Travlo provides assistance but does not guarantee approvals.
15. Force Majeure
  • Unforeseen Events: There can be exceptional circumstances where Travlo and/or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, operational and technical issues, route and flight cancellations, or any other reason beyond the control of Travlo.
  • Refunds: If Travlo has advance knowledge of such situations, it will make its best efforts to provide similar alternatives or refund the booking amount after deducting applicable service charges, if supported and refunded by the respective Service Providers.
  • No Liability: Travlo is not liable for damages, losses, or disruptions caused by Force Majeure events. Users must contact the Service Providers directly for further resolutions or refunds.
16. Advertisers on Travlo and Linked Websites
  • Third-Party Ads: Travlo hosts advertisements for third-party products and services but does not explicitly endorse, validate, or guarantee the accuracy, reliability, or quality of such products or services. Users are advised to exercise due diligence before engaging with any third-party advertisers or completing transactions through linked advertisements. Travlo is not responsible for any disputes or issues arising between Users and third-party advertisers. Any conflicts must be resolved directly with the respective advertisers, as Travlo does not mediate or bear liability in such matters.
  • User Discretion: Users must exercise caution when interacting with ads or linked sites.
  • Website Links: The Website may contain links to third-party websites. Travlo does not control such websites and is not responsible for their content. Accessing such sites is entirely at the User’s risk.
  • Advertiser Representations: Travlo is not responsible for errors, omissions, or representations on its pages, links, or any linked website pages to the extent such information is provided by advertisers.
  • Linked Sites: Travlo is not liable for the contents of linked sites or updates to such sites. These links are provided as a convenience, and Users are requested to verify the accuracy of all information provided on third-party web pages.
17. Right to Refuse

Travlo reserves the right to:

  • Deny service to any User without prior notice.
  • Block accounts breaching these Terms, especially if the User engages in activities such as fraudulent transactions, misuse of the Platform, or violation of legal and ethical standards.
  • Refuse access to Users who attempt to disrupt Platform operations, compromise data security, or engage in behavior detrimental to other Users or Service Providers.
  • Temporarily or permanently disable accounts identified as high-risk based on suspicious activity, excessive cancellations, or misuse of promotional offers.
  • Require additional verification or documentation to validate User identity and payment details if deemed necessary to ensure Platform integrity.
18. Right to Cancel
  1. User Responsibility for Accurate Information:
    • The User is expressly required to provide correct and valid information while using Travlo’s Website, application, or services under this User Agreement. Any misrepresentation or provision of false information may result in the denial of services or cancellation of bookings.
    • Travlo reserves the right to cancel bookings and refuse services if the information provided by the User or any associated traveler is deemed unauthorized, inaccurate, or misleading.

  2. Cancellation Due to Misrepresentation or Fraud:
    • If Travlo discovers or reasonably suspects, either before or after receiving a booking request, that the information provided by the User is unauthorized, false, or fraudulent, Travlo may take appropriate legal actions against the User.
    • Such actions may include cancellation of bookings without prior notice to the User. In such cases, Travlo shall not be liable for any loss or damage incurred by the User or any other party affected by the cancellation.
  3. Compliance with Legal and Government Authorities:
    • Travlo reserves the right to cancel any booking if instructed to do so by a judicial, quasi-judicial, investigative agency, or government authority. No prior intimation will be given to the User in such cases.
  4. Safeguarding Travlo’s Interests:
    • Travlo prioritizes safeguarding its platform, services, and the interests of its genuine customers. As such, it may deny or cancel bookings if fraud or misuse is suspected.
    • Measures to protect Travlo’s interests may include monitoring and acting upon suspicious activities, such as excessive cancellations, use of stolen payment methods, or any behavior deemed fraudulent.
  5. No Liability for Cancellations:
    • Travlo will not be held responsible for any loss, inconvenience, or damages arising from measures taken in good faith to protect its services, platform, or Users.
    • Users accept that Travlo’s decisions to deny, cancel, or refuse bookings are final and cannot be contested if based on suspected fraud or misrepresentation.
19. Fake Calls and Fraudulent Activities
  • No Personal Information Requests: Travlo, its employees, or authorized representatives will never contact Users to request sensitive personal or financial details, including but not limited to:

    • Credit/Debit card numbers

    • Expiry dates, CVV codes

    • Net banking login credentials or passwords

    • OTPs (One-Time Passwords)

    • Fund transfers to personal or non-Travlo bank accounts

  • No Third-Party App Installations: Travlo representatives will not request Users to install third-party applications that grant remote access to mobile or computer screens.

  • User Awareness: Users are advised to exercise caution and avoid sharing sensitive information under any circumstances. Acting on fraudulent requests can result in financial loss or identity theft. Travlo will not be liable for damages caused by such interactions initiated outside its official channels.

  • Reporting Fraud: Users must report any suspicious calls, emails, or messages to [email protected] or contact Travlo’s helpline immediately. Include details such as the caller’s number, email address, or screenshots of fraudulent communication to facilitate prompt investigation.

  • Prevention and Action: Travlo actively monitors and employs robust security measures to protect Users against fraud. However, Users must remain vigilant and take necessary precautions while interacting with unknown individuals or entities claiming to represent Travlo.

  • Indemnity: Travlo shall not be held accountable for losses arising from Users acting on fraudulent communications. Users agree to indemnify Travlo against claims, liabilities, and damages resulting from actions taken based on unauthorized communication.

20. Indemnification

Users agree to indemnify Travlo against all claims, damages, or losses arising from but not limited to:

  • Breach of Terms: Any violation of these Terms and Conditions by the User, resulting in legal actions, financial losses, or penalties.
  • Misuse of Services: Improper, unauthorized, or illegal use of Travlo’s platform, including fraudulent bookings, sharing of confidential information, or tampering with Platform functionality.
  • Third-Party Disputes: Issues or disputes involving third-party Service Providers, where the User’s actions contribute to claims against Travlo.
  • Violation of Laws: Non-compliance with local, national, or international laws while using Travlo’s services.
  • Intellectual Property Infringement: Any content uploaded or shared by the User that infringes upon copyrights, trademarks, or other proprietary rights of third parties.
  • Data Misuse:Unauthorized access, use, or disclosure of personal, sensitive, or financial information obtained through the Platform.
21. COVID-19 Related Terms and Conditions
  1. Compliance with Government Protocols:
    • Users are required to adhere to all COVID-19-related guidelines, restrictions, and protocols issued by local, state, national, and international authorities during their travel.
    • This includes but is not limited to vaccination mandates, mask requirements, social distancing norms, quarantine protocols, and health screening procedures at airports, hotels, and other service locations.
  2. Travel Restrictions:
    • Users must ensure that their chosen destination is open for travel and review any travel advisories or restrictions imposed by government authorities. Travlo shall not be responsible for cancellations, disruptions, or changes to bookings caused by COVID-19-related travel restrictions.
  3. Cancellations and Refunds:
    • Cancellation of bookings due to COVID-19-related reasons, such as changes in government regulations, positive test results, or quarantine requirements, will be governed by the policies of the respective service providers (e.g., airlines, hotels, or tour operators).
    • Refunds or credits for such cancellations will be processed based on the terms set by the service providers. Travlo will facilitate the refund process but does not guarantee any specific outcome.
  4. Health Declaration and Testing Requirements:
    • Users may be required to provide health declarations, vaccination certificates, or negative COVID-19 test results as mandated by authorities or service providers.
    • Failure to provide the required documentation may result in denied boarding, check-in, or access to services, for which Travlo will not be held liable.
  5. Additional Charges:
    • Users are solely responsible for any additional charges incurred due to COVID-19-related requirements, such as testing fees, quarantine accommodations, or mandatory health insurance.
  6. Travel Insurance:
    • Travlo strongly recommends Users purchase travel insurance that includes coverage for COVID-19-related incidents, such as trip cancellations, medical emergencies, or quarantine costs.
  7. Force Majeure Clause:
    • COVID-19 and its related disruptions fall under Travlo’s Force Majeure clause. In such cases, Travlo shall not be liable for delays, cancellations, or any losses incurred by the User.
  8. Personal Responsibility:
    • Users are responsible for monitoring their health before and during travel. Travlo shall not be liable for any health complications, infections, or losses resulting from exposure to COVID-19 during the journey or stay.
  9. Changes to Services:
    • Travlo and its Service Providers reserve the right to modify or limit services (e.g., limited dining, closed amenities, altered schedules) to comply with COVID-19 guidelines. Users are expected to review such changes before booking.
  10. Contactless Services:
    • Travlo encourages the use of contactless services, such as digital check-ins, cashless payments, and online customer support, to minimize physical interactions and enhance safety during travel.
22. UPI-Related Terms and Conditions
  1. Role of Travlo as TPAP: Travlo acts as a Third Party Application Provider (TPAP) authorized by NPCI, in partnership with ICICI Bank and IndusInd Bank, to facilitate UPI transactions securely and seamlessly.
  2. User Responsibilities: Users must link valid bank accounts, safeguard UPI credentials (PINs, passwords, OTPs), and avoid sharing sensitive information with anyone, including Travlo representatives.
  3. Grievance Redressal: Travlo is the first point of contact for UPI-related grievances. Unresolved issues can be escalated to the PSP Bank, the User’s bank, NPCI, and finally, the Banking Ombudsman or Ombudsman for Digital Complaints.
  4. Liability: Travlo is not responsible for errors arising from incorrect details provided by Users, technical failures, or issues with banks or PSPs. Disputes are governed by the User’s bank and NPCI policies.
  5. Security and Compliance: Travlo adheres to NPCI and RBI guidelines and ensures robust security measures. Users must report suspicious activity and avoid responding to fraudulent requests.
  6. Transaction Limits: UPI transactions are subject to NPCI and bank-defined limits, and Travlo imposes no additional restrictions unless specified.
  7. Modification of Terms: Travlo may update these terms, notifying Users of significant changes through appropriate channels.
23. Content Moderation
  • User Responsibility: Users are expected to ensure that any content they upload, share, or interact with on Travlo’s platform complies with applicable laws and community standards.
  • Prohibited Content: Travlo prohibits content that is offensive, defamatory, obscene, abusive, fraudulent, promotes hate speech, violates intellectual property rights, or is in breach of any legal or regulatory standards.
  • Moderation Practices: Travlo reserves the right to review, moderate, edit, or remove any content that violates these guidelines or is deemed inappropriate without prior notice to the User.
  • Reporting Mechanism: Users can report objectionable content through the designated channels. Travlo will investigate such reports and take appropriate action, including removal of content or suspension of accounts if necessary.
  • Liability Disclaimer: Travlo is not liable for any content posted by Users but takes reasonable steps to maintain a safe and respectful environment for all Users.
24. Recommendation System
  • Algorithm-Based Suggestions: Recommendations are generated using a combination of advanced algorithms and data analysis. The system considers factors such as user preferences, browsing history, past bookings, reviews, and popular trends to tailor suggestions. Travlo prioritizes personalization to enhance the user experience, while ensuring transparency and accuracy in the recommendation process. These recommendations are for informational purposes only and do not guarantee the availability or quality of services or experiences.

25. Miscellaneous
  • Severability: Invalid provisions do not affect the enforceability of remaining clauses.
